Poker IQ Privacy Policy

Plain-English Summary

1. Introduction and Scope

Scaleswift Digital Services LLP and Epic Merch LLC (together, "we," "us," or "our") operate Poker IQ, a poker training game available at https://mypokeriq.app and as an installable web app (the "Service"). This Privacy Policy explains what information we collect when you use the Service, how we use it, who we share it with, and the choices you have.

By using Poker IQ you acknowledge that you have read this Privacy Policy. If you do not agree with it, please do not use the Service. Additional disclosures for users in California, the EEA, the UK and other jurisdictions are in Section 13.

2. Information We Collect

2.1 Information You Give Us

  • The name you choose for the table (or "You" if you leave it blank) and your email address, when you sign up
  • Your poker experience level, which you pick during onboarding
  • Your settings and choices in the app, such as coaching level, tone, sound, avatar and table preferences
  • Anything you send us when you contact us

2.2 Your Gameplay

To save your progress and grade your play, we keep a record of how you play:

  • Every hand you play: your cards, the board, each action at the table and the result
  • Each of your decisions, with the grade and explanation the coach gave it
  • Your Poker IQ rating, play-chip balance, sessions, drills, daily puzzles, streaks and milestones

This record is kept in your browser and copied to our servers under your account.

2.3 Information Collected Automatically

  • An anonymous account identifier, created for your browser the first time you open Poker IQ
  • Device and browser information: browser type and version, screen and window size, pixel density, time zone, language, whether the app is installed, and whether the device has a touch screen
  • Your IP address and the approximate location derived from it
  • How you use the Service: screens and pages viewed, taps, clicks, how long things take, and when you come and go
  • Performance measurements (such as page load times) and reports of errors in the app

2.4 Session Recordings

We record sessions in the app: how the screen changed, and where you tapped, clicked and scrolled. We use these recordings to understand problems and improve the game. Everything you type into a field, including your name and email, is hidden and never captured in a recording. Messages the app writes to the browser console may be captured alongside a recording to help us diagnose errors.

2.5 Where You Came From

When you arrive from an ad or a link, we keep the campaign details in the address (such as utm_source and utm_campaign), ad click identifiers (from Meta, Google, TikTok or Microsoft), the site that referred you and the page you landed on. We also keep the identifiers Meta's cookies hold (see Section 5).

3. How We Use Your Information

  • To run the game, save your progress across visits, grade your decisions and calculate your Poker IQ
  • To send you your results and news about Poker IQ's launch. You can unsubscribe from any email
  • To understand how people use Poker IQ and make it better
  • To find and fix errors and performance problems
  • To measure how well our ads work (Section 5)
  • To keep the Service secure and prevent abuse
  • To comply with the law

We do not use your information to make decisions that have legal or similarly significant effects on you. Your Poker IQ rating reflects your play in the game and is used only inside the game.

4. Legal Bases for Processing

Where the law requires a legal basis (for example in the EEA and the UK), we rely on:

  • Contract: to provide the game you choose to use, including saving and grading your play
  • Legitimate interests: to understand usage, improve the Service, fix errors and keep it secure. You can object at any time
  • Consent: for advertising measurement cookies and the Meta Pixel, and for marketing email, where the law requires consent. You can withdraw it at any time
  • Legal obligation: where the law requires us to process or keep information

5. Advertising (Meta Pixel)

We use the Meta Pixel, a tool from Meta Platforms, to measure and improve our ads on Facebook and Instagram. It sets two cookies in your browser (_fbp and _fbc) and tells Meta when these things happen:

  • You open a page of Poker IQ
  • You sign up and finish onboarding
  • You finish your first hand, complete a table session, or complete a drill or the daily puzzle

These events carry simple game details, such as the table level, how many hands a session had and the type of drill, together with the page address, your IP address, your browser details and the Meta cookie identifiers. We do not send your name or your email address to Meta. Meta may combine this with information it already has to measure our ads and to show ads, under its own privacy policy: https://www.facebook.com/privacy/policy

You can opt out on this browser with the button below. If your browser sends a Global Privacy Control signal, we treat it as an opt-out automatically and do not load the Pixel. You can also limit ads in your Meta account settings.

This browser shares the events above with Meta.

6. How We Share Your Information

6.1 Service Providers

We share information with the companies that run parts of the Service for us, only for that purpose:

  • Supabase: our database and accounts (servers in Mumbai, India)
  • PostHog: product analytics, session recordings and error tracking (servers in the United States)
  • Vercel: hosting of the website (servers in the United States and worldwide)
  • Meta Platforms: advertising measurement (Section 5)
  • An email delivery provider, when we send you email

6.2 Business Transfers

If we are involved in a merger, acquisition, financing or sale of assets, your information may be transferred as part of that transaction. We will tell you if it leads to a material change in how your information is handled.

6.3 Legal Requirements

We may disclose information if we believe in good faith that it is necessary to comply with the law or legal process, to protect the rights, property or safety of anyone, or to enforce our terms.

6.4 What We Do Not Do

  • We do not sell your personal information
  • We do not send your name or email address to advertisers
  • We do not offer real-money gambling, and we do not share your information with gambling operators

7. Cookies and Similar Technologies

  • Necessary: your game progress, settings, sign-in and pending saves are kept in your browser's local storage, and a service worker keeps a copy of the app so it opens offline. The Service does not work without these
  • Analytics: PostHog stores an identifier in your browser to connect your visits (Sections 2.3 and 2.4)
  • Advertising: the Meta Pixel cookies _fbp and _fbc (Section 5), which you can turn off

You can clear all of this at any time in your browser settings. Clearing it also removes your game progress from that browser.

8. How Long We Keep Information

  • Your account, name, email and gameplay: for as long as your account exists, until you ask us to delete them
  • Game progress in your browser: until you clear your browser storage
  • Session recordings: 30 days
  • Analytics events: as long as needed to understand how the Service is used, after which they are deleted or anonymized
  • After a deletion request: deleted or anonymized within 30 days, unless we must keep something by law

9. Your Rights and Choices

  • Access and portability: ask for a copy of the information we hold about you
  • Correction: ask us to correct information that is wrong
  • Deletion: ask us to delete your account and everything connected to it
  • Objection and restriction: object to, or ask us to limit, certain processing
  • Withdraw consent: at any time, without affecting processing that already happened
  • Advertising opt-out: use the button in Section 5 or a Global Privacy Control signal
  • Email: unsubscribe using the link in any email

To use these rights, write to hello@mypokeriq.app from the email address you signed up with. Accounts are anonymous until you sign up, so that address is how we find yours. We may need to verify your request, and we will reply within 30 days (45 days for California requests). You may use an authorized agent with written permission.

10. Security

Information travels encrypted (TLS) and our providers encrypt it at rest. Each account can read and write only its own records, and access inside our team is limited to people who need it. No method of storage or transmission is completely secure; if a breach affects your information, we will notify you as the law requires.

11. Age Requirement

Poker IQ is intended for adults and is not directed at anyone under 18. We do not knowingly collect information from anyone under 18. If you believe someone under 18 has used the Service, contact hello@mypokeriq.app and we will delete their information.

12. International Transfers

Our database is hosted in India, and our analytics, hosting and advertising providers are primarily in the United States. Your information may therefore be processed in countries other than yours, where data protection laws may differ. For transfers from the EEA, the UK and Switzerland we rely on Standard Contractual Clauses; you can ask us for details.

13. Jurisdiction-Specific Disclosures

13.1 California (CCPA / CPRA)

In the last 12 months we have collected these categories of personal information: identifiers (name, email address, account identifier, IP address, cookie identifiers); internet and electronic activity (how you use the Service, session recordings); approximate location from your IP address; and inferences about your poker skill (your Poker IQ rating). The sources, purposes and recipients are described above.

  • We do not sell personal information
  • We share identifiers and activity with Meta for cross-context behavioral advertising (Section 5). You can opt out with the button there or a Global Privacy Control signal
  • We do not collect sensitive personal information as defined by California law
  • You have the rights to know, delete and correct, and we will not discriminate against you for using them

13.2 EEA, United Kingdom and Switzerland

In addition to the rights in Section 9, you may lodge a complaint with the data protection authority where you live. The data controllers are Scaleswift Digital Services LLP and Epic Merch LLC. We are not currently required to appoint a Data Protection Officer; send data protection questions to hello@mypokeriq.app.

13.3 Other US States and Other Countries

Residents of Virginia, Colorado, Connecticut, Texas and other states with privacy laws have rights similar to those in Section 9, including the right to opt out of targeted advertising. Wherever you live, contact hello@mypokeriq.app to use the rights your local law gives you.

15. Governing Law and Disputes

This Privacy Policy is governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. If you live outside the United States, the mandatory consumer protection and privacy laws of your country may also apply. Nothing in this section limits your right to complain to your local data protection authority or to bring a claim in your local courts where the law allows it.

16. Changes to This Policy

We may update this Privacy Policy. For material changes, meaning changes to what we collect, how we use it or who we share it with, we will email you before the change takes effect. For other changes we will update the date at the top of this page.
